Cyprus IP Box for AI and machine-learning businesses

Assess software rights, model components, income and R&D evidence before claiming Cyprus IP Box relief for an AI business.

In short

An AI business may qualify through original software or another eligible asset, but not every model, weight file, dataset or generated output automatically has the necessary rights or tax treatment. Identify the protected asset, the company’s rights, attributable net income and supported nexus expenditure before calculating relief.

Identify the asset, not just the AI label

Original program expression can be protected by copyright; ideas and principles are not protected as program expression. Do not assume that model architecture, trained weights, raw data and source code all share one automatic copyright conclusion.

Separate human-authored code, generated material, third-party models and datasets. Establish the relevant legal rights for each component and the company’s entitlement to exploit them. A commercial product description is not a rights analysis.

Map each revenue stream to the qualifying asset

API charges, subscriptions and licences require analysis of what the customer actually receives. Fees do not qualify merely because they are billed per token or described as AI revenue.

Distinguish attributable software income from consulting, resale and other activities. Mixed contracts need a supported allocation of income and expenses. The deduction applies to qualifying net income through the nexus fraction, not automatically to total sales.

Classify development spending and calculate the capped uplift

QE means qualifying R&D expenditure, including qualifying unrelated-party development. Let A be acquisition cost and R related-party R&D. OE = QE + A + R; UE = min(30% × QE, A + R); nexus = min(1, (QE + UE) / OE) where OE is positive.

Training compute can require a different analysis from production inference hosting. Classify the actual activity and retain evidence; neither all GPU spending nor every developer salary automatically belongs in QE. A missing expenditure history cannot be treated as full nexus.

Review third-party and open-source dependencies

Check licences, assignments and the rights required for the intended commercial use. Building on an external model does not automatically disqualify the business, but neither does it make the company owner of the underlying model.

Separate acquisition expenditure from supported development expenditure. Keep repository history, experiment records, contracts, asset-level costs and income allocations. A patent is not universally required for software, but software ownership and originality still need support.

Apply the tax formula to a supported result

Assume €200,000 of qualifying net IP income and a properly established nexus of 75%. The deduction is €200,000 × 75% × 80% = €120,000. The remaining €80,000 produces €12,000 corporate tax at 15%, or 6% of that net income.

At full nexus the simplified corporate result would be 3%. These examples do not establish eligibility for a particular model and exclude other taxes and adjustments. Review the position when rights, suppliers, revenue streams or development arrangements change.
